These Terms of Service ("Terms") govern your access to and use of the SERVE IQ LTD. website and POS platform (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. About SERVE IQ
SERVE IQ LTD. ("SERVE IQ", "we", "us", or "our") provides point-of-sale and hospitality management software for restaurants and related businesses in the United Kingdom. Contact: contact@serveiq.co.uk.
2. Eligibility and accounts
- You must be authorised to enter into these Terms on behalf of your business.
- You are responsible for maintaining the confidentiality of account credentials and for all activity under your account.
- You must provide accurate and complete information when registering or requesting a demo.
3. Use of the Services
You agree to use the Services only for lawful business purposes. You must not:
- Attempt to gain unauthorised access to our systems or other customers' data
- Interfere with or disrupt the integrity or performance of the Services
- Copy, reverse engineer, or resell the Services except as expressly permitted in writing
- Use the Services to process unlawful transactions or content
4. Subscriptions and payments
Paid plans, fees, billing cycles, and payment terms are agreed separately (for example in an order form, proposal, or subscription agreement). Fees are non-refundable except where required by law or expressly stated otherwise. We may suspend access for overdue accounts after reasonable notice.
5. Customer data
You retain ownership of data you submit to the platform ("Customer Data"). You grant SERVE IQ a limited licence to host, process, and display Customer Data solely to provide and improve the Services. You are responsible for ensuring you have the rights and consents needed to process Customer Data through SERVE IQ, including any personal data of your staff or customers.

6. Intellectual property
The Services, including software, design, branding, and documentation, are owned by SERVE IQ LTD. or its licensors. These Terms do not transfer any ownership rights to you. You may not use our trademarks without prior written consent.
7. Availability and support
We aim to keep the Services available and reliable, but we do not guarantee uninterrupted or error-free operation. Scheduled maintenance and circumstances beyond our reasonable control may affect availability. Support channels and response times may vary by plan.
8. Disclaimer
The Services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are not permitted under applicable law.
9. Limitation of liability
To the maximum extent permitted by law, SERVE IQ LTD. shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business opportunities. Our total aggregate liability arising out of or related to the Services shall not exceed the fees paid by you to SERVE IQ in the twelve (12) months preceding the claim. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
10. Termination
Either party may terminate a paid subscription in accordance with the applicable agreement. We may suspend or terminate access if you materially breach these Terms and fail to remedy the breach after notice. Upon termination, your right to use the Services ceases. Provisions that by their nature should survive (including intellectual property, liability limits, and confidentiality) will continue to apply.
11. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date will reflect the latest version. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of England and Wales. Courts of England and Wales shall have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction to protect our rights.
